Working in the legal industry for as long as we have has given us a unique outlook on human nature; particularly when it comes to the area of family law and divorce. Since being involved in more divorce cases than we can count, we feel that it is our duty to share the pearls of wisdom we have gleaned. Quite honestly, it could save you hundreds, if not thousands of dollars in the long run!
As everyone in the State of Arizona knows, Arizona is a community property state. While AZ Legal DocuPrep is not permitted to dispense legal advice, it is pretty much common knowledge what community property means. Being privy to some quite nasty divorce cases, we can honestly tell you that everyone wants their “community” share; but at what cost?
A divorce is most definitely one of the most traumatizing and emotionally exhausting experiences a person can go through, but what most individuals don’t keep in mind when dealing with the division of their home, finances, bank accounts and personal property is that while each party may want their equal share, sometimes everything cannot be divided equally. There are just some things accumulated during a marriage that will end up with one person or the other.
Taking children out of the equation (which is almost a necessity at this point since divorces with children are a much different scenario and arguing over who is the most fit parent should be best saved for professionals in this field), we have literally seen couples argue over pets, vehicles, knick-knacks and yes, even the kitchen sink!
What it should be important for every individual to think about is that only one party will be awarded the item in controversy and can one really consider it a victory if they drag their issue through extensive litigation, (not to mention in some cases thousands of dollars in attorney’s fees) just to leave it up to a judge to decide who gets Rover? Only one person is inevitably going to end up being awarded the item in question. Is it still a victory after all is said, done and paid for in one way or another?
What we have heard time and time again is that the “reasonable” party usually prevails. Therefore, why not try to be the reasonable party from the onset and save yourself thousands of dollars, extensive time and emotional aggravation? In this economy in particular, wouldn’t the money saved dragging your controversy through court be better used on a nice, relaxing, and much-needed vacation? Now that’s worth it!
